This report card assesses the civil liberties record of Governor Phil Scott on a pass\/fail basis over his current two-year term, 2023-24, looking at a range of public policy choices that impact Vermonters\u2019 rights and liberties statewide.&nbsp;<\/p>\n<p>While his track record in prior terms has been mixed, Governor Scott\u2019s policies and positions over the past two years have proven increasingly hostile to Vermonters\u2019 civil liberties, as well as the needs and values of Vermont families and communities. &nbsp;<\/p>\n<hr>\n<p><img loading=\"lazy\" decoding=\"async\" class=\" size-full wp-image-2158\" src=\"https:\/\/www.acluvt.org\/app\/uploads\/2024\/04\/pass_fail_9.png\" alt=\"Homessless: Pass \/ Fail with Fail circled\" style=\"height: 100px; width: 400px;\" width=\"1200\" height=\"300\" srcset=\"https:\/\/www.acluvt.org\/app\/uploads\/2024\/04\/pass_fail_9.png 1200w, https:\/\/www.acluvt.org\/app\/uploads\/2024\/04\/pass_fail_9-768x192.png 768w, https:\/\/www.acluvt.org\/app\/uploads\/2024\/04\/pass_fail_9-400x100.png 400w, https:\/\/www.acluvt.org\/app\/uploads\/2024\/04\/pass_fail_9-600x150.png 600w, https:\/\/www.acluvt.org\/app\/uploads\/2024\/04\/pass_fail_9-800x200.png 800w, https:\/\/www.acluvt.org\/app\/uploads\/2024\/04\/pass_fail_9-1000x250.png 1000w\" sizes=\"auto, (max-width: 1200px) 100vw, 1200px\" \/><\/p>\n<p>The ability to access housing is fundamental to the enjoyment of civil liberties and full and free participation in our society. Under Governor Scott, Vermont now has the <a href=\"https:\/\/www.vhfa.org\/news\/blog\/rate-homelessness-vermont-remains-2nd-highest-us-2023\">second highest rate of homelessness in the country<\/a> and faces an affordable housing crisis that will take years to reverse.&nbsp;&nbsp;&nbsp;<\/p>\n<p>In 2023, amid a historic housing crisis, <a href=\"https:\/\/www.acluvt.org\/en\/press-releases\/aclu-statement-vermonts-emergency-housing-program\">the governor sought to forcibly un-shelter hundreds of Vermonters<\/a> \u2014 children, families, seniors, and people with disabilities. This year, the administration has displaced scores of people while enacting <a href=\"https:\/\/vtdigger.org\/2024\/03\/15\/while-state-stands-up-shelters-some-vermonters-exit-motels-without-a-plan\/\">cruel and arbitrary barriers to undermine the legislature\u2019s emergency housing program<\/a> and prevent people with disabilities and other vulnerable Vermonters from accessing shelter. &nbsp;<\/p>\n<p>This winter, the Scott administration provided four short-term overnight group shelters for evictees that were haphazardly appointed, remotely located, and in one case lacked indoor bathrooms. Yet, while the number of people who have died of drug overdoses has increased dramatically during Scott\u2019s term, he has <a href=\"https:\/\/vtdigger.org\/2024\/01\/11\/vermont-house-advances-bill-to-establish-overdose-prevention-centers\/\">consistently opposed harm reduction strategies<\/a> that would save lives and improve community health and safety, while <a href=\"https:\/\/vtdigger.org\/2023\/01\/22\/public-safety-department-plans-to-launch-statewide-crime-heat-map-dashboard\/\">stoking fears about public safety in one of the safest states in the country<\/a>.&nbsp;<\/p>\n<p>The governor has doubled down on the failed strategies of the past by <a href=\"https:\/\/www.vermontpublic.org\/local-news\/2023-11-21\/gov-scott-has-a-plan-to-address-crime-the-aclu-of-vermont-strongly-opposes-it\">supporting harsher criminal penalties for drug-related offenses<\/a> and <a href=\"https:\/\/www.juvjustice.org\/blog\/1174\">undermining historic \u201craise the age\u201d reform<\/a> passed by the legislature in 2018.&nbsp;<\/p>\n<p>And, while working to un-shelter hundreds of vulnerable Vermonters, the Scott administration has simultaneously been <a href=\"https:\/\/www.acluvt.org\/en\/campaigns\/reject-prison-expansion\">advancing costly proposals to expand Vermont's prison system<\/a> rather than investing in more humane and cost-effective alternatives.&nbsp;<\/p>\n<hr>\n<p><img loading=\"lazy\" decoding=\"async\" class=\" size-full wp-image-2162\" src=\"https:\/\/www.acluvt.org\/app\/uploads\/2024\/04\/pass_fail_10.png\" alt=\"Education Equity: Pass \/ Fail with Fail circled\" style=\"height: 100px; width: 400px;\" width=\"1200\" height=\"300\" srcset=\"https:\/\/www.acluvt.org\/app\/uploads\/2024\/04\/pass_fail_10.png 1200w, https:\/\/www.acluvt.org\/app\/uploads\/2024\/04\/pass_fail_10-768x192.png 768w, https:\/\/www.acluvt.org\/app\/uploads\/2024\/04\/pass_fail_10-400x100.png 400w, https:\/\/www.acluvt.org\/app\/uploads\/2024\/04\/pass_fail_10-600x150.png 600w, https:\/\/www.acluvt.org\/app\/uploads\/2024\/04\/pass_fail_10-800x200.png 800w, https:\/\/www.acluvt.org\/app\/uploads\/2024\/04\/pass_fail_10-1000x250.png 1000w\" sizes=\"auto, (max-width: 1200px) 100vw, 1200px\" \/><\/p>\n<p>The people of Vermont care deeply about our system of public education. We want all students to receive an equitable, supportive education free from discrimination and harassment. The Scott administration is undermining these values and our system of public education itself.&nbsp;&nbsp;<\/p>\n<p>While students of color, students with disabilities, and low-income students have long been <a href=\"https:\/\/www.usccr.gov\/files\/pubs\/2020\/02-19-VT-SAC-School-Disparities.pdf\">targeted disproportionately for school discipline<\/a>, Scott\u2019s administration has <a href=\"https:\/\/www.wcax.com\/2021\/02\/09\/governor-opposes-bill-banning-vt-districts-from-contracting-school-resource-officers\/\">opposed limits on \u201cschool resource officers\u201d (school cops)<\/a> and championed legislation creating <a href=\"https:\/\/www.acluvt.org\/en\/stop-bta\">\u201cbehavioral threat assessment teams\u201d<\/a> in all Vermont school districts. That law encourages police and administrators to monitor and investigate students of any age\u2014for common, age-appropriate actions like \u201cunusual or bizarre communications or behavior\u201d\u2014undermining students\u2019 rights and threatening to compound existing disparities.&nbsp;<\/p>\n<p>In the wake of the Supreme Court\u2019s disastrous ruling in\u202f<em>Carson v. This biennium, less than three years after <a href=\"https:\/\/governor.vermont.gov\/press-release\/statement-governor-phil-scott-anniversary-george-floyd%E2%80%99s-death\">signing a proclamation for \u201cGeorge Floyd Remembrance Day\u201d<\/a> and committing to \u201ccontinu[ing] to acknowledge systemic racism and inequality,\u201d Governor Scott and his administration have consistently opposed meaningful police reform. &nbsp;&nbsp;<\/p>\n<p>In 2023, he vetoed a law that would have <a href=\"https:\/\/www.vermontpublic.org\/local-news\/2023-06-01\/gov-phil-scott-vetoes-bill-to-ban-deceptive-police-interrogation-tactics-with-young-people-vermont\">prevented police from lying to children in interrogations<\/a>. In 2024 his administration opposed measures to <a href=\"https:\/\/action.aclu.org\/send-message\/vt-smarter-stops\">reduce overpolicing and racial bias on our roadways<\/a> by limiting unnecessary law enforcement interactions.&nbsp;<\/p>\n<p>The governor has taken no steps to address persistent racial profiling and racial disparities in the criminal legal system, which remain among the worst in the nation. His <a href=\"https:\/\/www.vermontpublic.org\/local-news\/2023-11-21\/gov-scott-has-a-plan-to-address-crime-the-aclu-of-vermont-strongly-opposes-it\">public safety \u201cplan\u201d announced in 2023<\/a> makes no mention of racial justice or police accountability.&nbsp;&nbsp;<\/p>\n<p>With the legislature unwilling or unable to advance police reform given the inevitability of a veto, the governor bears significant responsibility for Vermont\u2019s lack of progress on racial justice and police accountability.&nbsp;<\/p>\n<hr>\n<p><img loading=\"lazy\" decoding=\"async\" class=\" size-full wp-image-2166\" src=\"https:\/\/www.acluvt.org\/app\/uploads\/2024\/04\/pass_fail_11.png\" alt=\"Economic Justice: Pass \/ Fail with Fail circled\" style=\"height: 100px; width: 400px;\" width=\"1200\" height=\"300\" srcset=\"https:\/\/www.acluvt.org\/app\/uploads\/2024\/04\/pass_fail_11.png 1200w, https:\/\/www.acluvt.org\/app\/uploads\/2024\/04\/pass_fail_11-768x192.png 768w, https:\/\/www.acluvt.org\/app\/uploads\/2024\/04\/pass_fail_11-400x100.png 400w, https:\/\/www.acluvt.org\/app\/uploads\/2024\/04\/pass_fail_11-600x150.png 600w, https:\/\/www.acluvt.org\/app\/uploads\/2024\/04\/pass_fail_11-800x200.png 800w, https:\/\/www.acluvt.org\/app\/uploads\/2024\/04\/pass_fail_11-1000x250.png 1000w\" sizes=\"auto, (max-width: 1200px) 100vw, 1200px\" \/><\/p>\n<p>When everyone\u2019s basic needs are met, our communities and our democracy can thrive. Investing in our state isn\u2019t just the right thing to do\u2014ensuring that all of us can more fully enjoy our civil rights and civil liberties\u2014it\u2019s also fiscally responsible.&nbsp;<\/p>\n<p>In an era of historic wealth inequality, the governor refuses to ask the wealthiest Vermonters to pay their fair share. Meanwhile, he has made misleading statements about widely popular proposed taxes on corporations and the wealthy, and&nbsp;<a href=\"https:\/\/vtdigger.org\/2024\/02\/08\/final-reading-a-small-fraction-of-a-small-fraction-lawmakers-weigh-risks-of-millionaire-tax-flight\/\">claimed, without evidence or analysis, that affluent residents will flee the state.<\/a><\/p>\n<p>The governor even opposes a <a href=\"https:\/\/vtdigger.org\/2024\/04\/11\/lawmakers-weigh-funding-new-judicial-positions-with-higher-corporate-taxes-and-fees\/\">modest tax on corporations that would help to staff Vermont\u2019s judiciary<\/a>\u2014a position squarely at odds with his stated interest in promoting public safety, and one that threatens to undermine a pillar of democratic government, our court system. &nbsp;<\/p>\n<hr>\n<h2>Conclusion<\/h2>\n<p>As Vermont\u2019s premier civil liberties organization, the ACLU gives Governor Scott and his administration a failing grade across the categories detailed above\u2014 homelessness, drug policy, criminal justice, education, police accountability, and economic justice.&nbsp;<\/p>\n<p>Vermont needs leadership that will advance collaborative solutions to secure and expand the rights and liberties of everyone who calls Vermont home. We must do better. This biennium, less than three years after <a href=\"https:\/\/governor.vermont.gov\/press-release\/statement-governor-phil-scott-anniversary-george-floyd%E2%80%99s-death\">signing a proclamation for \u201cGeorge Floyd Remembrance Day\u201d<\/a> and committing to \u201ccontinu[ing] to acknowledge systemic racism and inequality,\u201d Governor Scott and his administration have consistently opposed meaningful police reform.   \n\nIn 2023, he vetoed a law that would have <a href=\"https:\/\/www.vermontpublic.org\/local-news\/2023-06-01\/gov-phil-scott-vetoes-bill-to-ban-deceptive-police-interrogation-tactics-with-young-people-vermont\">prevented police from lying to children in interrogations<\/a>. In 2024 his administration opposed measures to <a href=\"https:\/\/action.aclu.org\/send-message\/vt-smarter-stops\">reduce overpolicing and racial bias on our roadways<\/a> by limiting unnecessary law enforcement interactions. \n\nThe governor has taken no steps to address persistent racial profiling and racial disparities in the criminal legal system, which remain among the worst in the nation. His <a href=\"https:\/\/www.vermontpublic.org\/local-news\/2023-11-21\/gov-scott-has-a-plan-to-address-crime-the-aclu-of-vermont-strongly-opposes-it\">public safety \u201cplan\u201d announced in 2023<\/a> makes no mention of racial justice or police accountability.  \n\nWith the legislature unwilling or unable to advance police reform given the inevitability of a veto, the governor bears significant responsibility for Vermont\u2019s lack of progress on racial justice and police accountability. Investing in our state isn\u2019t just the right thing to do\u2014ensuring that all of us can more fully enjoy our civil rights and civil liberties\u2014it\u2019s also fiscally responsible. \n\nIn an era of historic wealth inequality, the governor refuses to ask the wealthiest Vermonters to pay their fair share. Meanwhile, he has made misleading statements about widely popular proposed taxes on corporations and the wealthy, and <a href=\"https:\/\/vtdigger.org\/2024\/02\/08\/final-reading-a-small-fraction-of-a-small-fraction-lawmakers-weigh-risks-of-millionaire-tax-flight\/\">claimed, without evidence or analysis, that affluent residents will flee the state.<\/a>\n\nThe governor even opposes a <a href=\"https:\/\/vtdigger.org\/2024\/04\/11\/lawmakers-weigh-funding-new-judicial-positions-with-higher-corporate-taxes-and-fees\/\">modest tax on corporations that would help to staff Vermont\u2019s judiciary<\/a>\u2014a position squarely at odds with his stated interest in promoting public safety, and one that threatens to undermine a pillar of democratic government, our court system.
